Marketplace and E-commerce Terms of Service

1) Who we are and acceptance of terms

The Bombarda Marketplace and E-commerce platform is operated by the Associação Quarteirão Criativo (“AQC”), NIPC 516903551 , headquartered at Rua do Rosário, 211, 4050-524 Porto , contact email info@bombarda.pt . This Bombarda Marketplace and E-commerce platform is an integral part of the Bombarda Digital project.

By accessing or using the Bombarda Marketplace and E-commerce platform, the User accepts these Terms of Service (“Terms”). If you do not agree, you should not use the Bombarda Marketplace and E-commerce platform.

AQC may change these Terms at any time by posting the updated version. Continued use after posting signifies acceptance of the changes.

2) What is Marketplace and E-commerce Bombarda?

The Bombarda Marketplace and E-commerce platform allows the advertising and sale of products/services by third-party sellers (“Sellers”), as well as, where applicable, by AQC itself (“AQC Store”).

• Purchase and sale agreement: in purchases from Sellers, the contract is entered into between the Customer and the Seller . AQC is not a party to this contract, acting as the manager of the Bombarda Marketplace and E-commerce platform.
  
  
• AQC Store: when the indicated seller is "AQC Store", AQC is the selling party for that specific order.

3) Website usage

It is forbidden:
(i) violate laws or the rights of third parties;
(ii) attempting to access areas/accounts without authorization;
(iii) introduce malware;
(iv) use the Platform for fraudulent purposes;
(v) to circumvent technical measures.
AQC may suspend or terminate access for violation of these Terms.

4) Content and Intellectual Property

Unless otherwise indicated, the design , software , logos , trademarks , and content of the Bombarda Marketplace and E-commerce belong to the Bombarda Digital project. Reproduction, modification, distribution, or commercial exploitation without prior written consent is prohibited.
The content posted by Sellers is the sole responsibility of the Sellers. AQC may remove content that violates the law or these Terms.

5) Accounts, orders and payments

• Account: The user must provide truthful information and keep their credentials secure.
• Orders: During the purchase process, the User accepts the terms and conditions of the Seller or AQC Store (price, deadlines, shipping, applicable return policy).
• Payments: Only payments to AQC Loja are processed by AQC itself and the platform; in the case of "Sellers" (all stores that are not AQC Loja), payments may be processed by external payment service providers and will be made through contact via WhatsApp or another means to be agreed upon between the user/customer and the seller, with the platform manager (Associação Quarteirão Criativo - AQC/AQC Loja) having no responsibility for this payment. Payment confirmation does not guarantee stock availability; in case of unavailability, the amount will be refunded.
• Billing: When the seller is a third party (all stores that are not AQC Loja), the invoice is issued by the seller . For sales made by AQC Loja, the invoice is issued by AQC.

6) Shipping, returns and warranties (summary)

Shipping conditions , deadlines , costs , returns and legal guarantees are defined by each Seller , in accordance with applicable law (including Decree-Law No. 24/2014 and Decree-Law No. 84/2021 , when applicable).

AQC provides model policies and contact information for support regarding the Bombarda Marketplace and E-commerce below. In case of conflict, the Seller's terms and conditions presented on the product/checkout page and applicable legislation prevail .

7) External links

The Bombarda Marketplace and E-commerce site may contain links to third-party websites. AQC is not responsible for the content or practices of these sites.

8) Exclusion of liability and limitations

The Bombarda Marketplace and E-commerce platform is provided “as is.” AQC does not guarantee uninterrupted operation or error-free operation. To the maximum extent permitted by law, AQC is not liable for indirect damages or lost profits related to the use of the Platform. These Terms do not limit consumer rights that cannot be excluded by law.

9) Privacy and cookies

The processing of personal data is governed by Shopify's Privacy Policy and Cookie Policy .

11) Use of Images, Videos and Other Content (Sellers)

When sellers add content (2D or 3D images, videos, portraits, text, or other visual or text materials) to their merchant and store profile on the Bombarda Marketplace and E-commerce platform , they grant permission to... The Creative Quarter Association (AQC) authorizes the use, reproduction, editing, public communication and dissemination of this content for the purposes of exhibiting, promoting and selling my products, works or services.

This authorization applies to content uploaded by sellers to the platform and allows its use on the following channels associated with the project:

• Site/Portal bombarda.pt, Bombarda mobile app, Bombarda Digital kiosks;

• Social media, communication materials, and institutional content ;

• Channels and platforms of Bombarda Digital's official partners ( Municipality of Porto, Porto Digital Association and AHRESP ).

The license is non-exclusive, royalty-free, worldwide, and sublicensable only to project providers and partners for the purposes described above.

This remains valid as long as the seller profile is active or until a request is made to remove the content , via email to info@bombarda.pt or by mail to Rua do Rosário, 211, 4050-524 Porto .

By accepting the terms of service, sellers declare that they hold all necessary rights (including copyright, image, design, trademarks, or related rights) and assume responsibility for any third-party claims, releasing the Quarteirão Criativo Association from any liability and authorizing the use of the content under the terms defined herein.

In the event of revocation, AQC will remove the content from the platform prospectively, while the use already incorporated in previous materials or publications will remain valid.

12) Law and jurisdiction

These Terms are governed by Portuguese law . For disputes, the court of the district of Porto shall have jurisdiction, without prejudice to the mandatory rules for consumer protection and alternative dispute resolution (ADR) where applicable.
